Welcome to the website of Fundația Montessori Cluj (hereinafter the "Website"). These Terms and Conditions ("Terms") govern access to and use of the Website and the services offered by Fundația Montessori Cluj ("we", "our", the "Foundation"), a private educational institution based on the authentic Montessori model, located at Str. Brașov, Nr.33, Cluj-Napoca.

By accessing, browsing, or using this Website and our services (including, but not limited to, application forms, the shop, seminars, e-books, events, and blog), you agree to comply with and be bound by these Terms and our Privacy Policy. If you do not agree to these Terms, please do not use the Website or our services.

Website: Refers to the website of the Montessori Cluj Foundation, available at https://montessori-cluj.ro/.
User/Client: Any natural or legal person who accesses or uses the Website and/or the services offered by the Foundation.
Services: All features and offerings available on the Website, including the enrollment form, online store, seminars, e-books, events and blog content.
Product: Any physical goods available for purchase through the Foundation’s online shop.
Digital Content: E-books, seminar materials, and any other information or digital files offered for download or access.

2.1. Access to and use of the Website are permitted to individuals aged 18 or over. Minors may use the services (enrolment, purchases) only under the supervision and with the consent of a parent or legal guardian.

2.2. The User agrees to use the Website and services lawfully and appropriately, without infringing the rights of the Foundation or third parties. Any action that could affect the functionality, security, or integrity of the Website is prohibited.

2.3. The Foundation reserves the right to modify, suspend or discontinue the services, or any part thereof, temporarily or permanently, without prior notice, at any time.

3.1. By completing and submitting the enrolment forms available on the Website, the User confirms that all information provided is complete, accurate, and up to date.

3.2. The application process and selection criteria are detailed in each application form or on dedicated pages. The Foundation reserves the right to accept or reject an application based on its own criteria and the availability of places.

3.3. Enrollment and tuition fees are specified separately and may be changed by the Foundation with prior notice.

3.4. Personal information collected through enrollment forms is processed in accordance with the Foundation’s Privacy Policy.

4.1. Orders and Prices: * All prices displayed on the Website are in RON and include applicable VAT, where applicable. * The Foundation reserves the right to change product prices at any time without prior notice; however, the price displayed when the order is placed will apply. * Placing an order constitutes an offer to purchase by the User. A sales contract is considered concluded when the Foundation confirms the order by email.

4.2. Payment: * Products can be paid for by
bank card online. * For online payments, we use secure payment processing services provided by third parties. The Foundation does not store your card details.

4.3. Product Collection: * Orders for products placed online are prepared for collection in person. * Collection is from the Montessori Cluj kindergarten at Strada Nicolae Drăgan, Numărul 2, Cluj-Napoca. * Collection is available every Wednesday from 16:00 to 17:00, from the library. * The Customer is responsible for collecting the order at the specified time and location. If the order is not collected within 2 weeks
of being made available for collection, the Foundation reserves the right to cancel the order and retain the cost of the products. * At collection, the customer may be asked to present an ID and/or order confirmation.

4.4. Returns and Cancellation Policy: * Products sold by Fundația Montessori Cluj through the online shop, given their educational and/or personalized nature, are not eligible for return. By placing an order, you confirm and accept this policy. * This exception is in accordance with legal provisions concerning distance contracts for goods that are liable to deteriorate or expire rapidly, or that are made to the consumer's specifications or clearly personalized. * An order may only be cancelled before it is confirmed by the Foundation or before the package is prepared for collection. To request a cancellation, please contact us urgently at schule@montessori-cluj.ro or +4+40758 633 664.

5.1. Registration and Fees: * Registration for seminars and events is completed by filling out the relevant form and paying the participation fee, where applicable. * Places are limited and are allocated in order of confirmed paid registration.

5.2. Cancellation Policy: * Cancellation of attendance at a seminar/event by the User: * Cancellations made at least
7 business days before the seminar/event date may be eligible for a full refund of the fee, less any bank charges. * Cancellations made less than
7 business days before the seminar/event date may result in some or all of the participation fee being retained, depending on expenses already incurred by the Foundation (e.g., materials, venue hire). * Failure to attend without prior notice does not entitle the User to a refund. * Cancellation of the seminar/event by the Foundation: * The Foundation reserves the right to cancel or postpone a seminar/event for unforeseen reasons (e.g., insufficient number of participants, lecturer unavailable). In this case, fees paid will be refunded in full or the opportunity to attend a future session will be offered.

5.3. Intellectual Property Rights: The teaching materials distributed at seminars/events are the intellectual property of the Foundation or the lecturers and may not be reproduced, distributed or used for commercial purposes without prior written consent.

8.1. All content on the Website, including but not limited to text, images, logos, graphic elements, videos, software, databases, teaching materials, and e-books, is the property of Fundația Montessori Cluj and/or its content providers and is protected by Romanian and international copyright and intellectual property laws.

8.2. Any reproduction, distribution, transmission, display, modification, sale or exploitation of any part of the Website content without the Foundation’s prior written consent is prohibited.

9.1. Fundația Montessori Cluj makes every effort to ensure the accuracy and currency of the information on the Website, but does not guarantee that it is error-free.

9.2. The Foundation shall not be liable for any direct, indirect, incidental, special, or consequential damages arising from the use or inability to use the Website or our services, including, but not limited to, loss of profits, data, or other intangible property.

9.3. The Foundation shall not be liable for delays or inability to fulfill its contractual obligations due to force majeure events, including but not limited to natural disasters, wars, acts of terrorism, strikes, communications network outages or government restrictions.
